Booking Conditions
 

1. INTRODUCTION

DIRECT FLIGHTS INTERNATIONAL PTY LTD 65 053 400 463 AR 267102 trading as FlightsFlights is a licensed travel agency and airline consolidator, operating under the travel agents’ license number 2TA003432. Throughout this document DIRECT FLIGHTS INTERNATIONAL PTY LTD 65 053 400 463 AR 267102 trading as FlightsFlights will be written as FlightsFlights.

The travel arrangements available from FlightsFlights include:

  • Arrangements where FlightsFlights acts as a retail agent of the tour operator. The customer will be required to comply with the booking terms and conditions of that tour operator.

  • Arrangements where FlightsFlights acts as the principal. Such bookings are made on the basis of the following conditions and any other information supplied to all persons named on the booking including any added or substituted at a later date.

Reading these booking conditions forms part of your contract with FlightsFlights.

Please read these booking conditions carefully. On making a booking online, or signing our booking form when making a reservation over the phone or by email, you are deemed to have read and accepted our Booking Conditions, and are accepting the terms of these conditions on behalf of all persons in the party.

This contract is governed by Australian Law and both parties agree to submit to the jurisdiction of the Australian Courts at all times unless you decide to refer to arbitration under clause 11.

2. YOUR FINANCIAL PROTECTION

FlightsFlights is a member of IATA (02 34167 3) and also a member of the TCF. (Travel Compensation Fund). TCF membership number: 2/4349.

3. YOUR ARRANGEMENT WITH US

Your contract with FlightsFlights starts when you complete, sign and return our booking form, or make a reservation online. If the required deposit and/or balance is not paid by the specified due dates, your booking will be cancelled, in which case FlightsFlights will retain your deposit as well as any additional cancellation fees as outlined below in section 6.

4. PAYMENTS AND TICKETS

Payments

FlightsFlights accepts Visa, MasterCard and AMEX, as well as payment through BPay, Australia Post Bill Pay, and Electronic Funds Transfer.

The following fees are levied on credit card payments:

  • MasterCard, Visa and Bankcard: 1.7%
  • American Express: 3.5%

FlightsFlights requires that anyone wishing to pay by credit card complete and return the FlightsFlights’ Credit Card Authorisation Form. Ticket prices will not be confirmed nor tickets issued until payment is received and the Credit Card Authorisation Form is returned. Should you not complete and return the Credit Card Authorisation Form or secure an alternate payment method, your booking will be cancelled and you will incur a Booking Cancellation Fee as outlined in section 6.

Ticketing

Tickets will be issued in accordance with deadlines written into the applicable fare.

  • Wherever possible, Electronic Ticketing will be arranged at no additional charge.
  • Tickets may also be picked up at the FlightsFlights office in Sydney at no additional charge.

Please note: prices are not guaranteed until full payment and the Credit Card Authorisation Form (if choosing to pay by credit card), has been received and your tickets have been issued.

5. INSURANCE

Though travel insurance is not a requirement of travelling, it is highly recommended, especially for overseas travel, where your Australian insurance does not apply. FlightsFlights strongly encourages you to either purchase travel insurance through the booking process on www.flightsflights.com.au, or secure a policy with adequate cover for your travel needs through your own insurance institution.

6. PASSENGER CHANGES AND CANCELLATIONS

"Booking" and "Issuing" Definitions:

"Booking" occurs when you have committed to purchasing travel arrangements through FlightsFlights, but before FlightsFlights has received final payment, received the completed Credit Card Authorisation Form (if paying by credit card), and has sent your electronic tickets to you.

  • You have selected to pay by credit card and have filled in your credit card details, but BEFORE you have completed and returned the mandatory Credit Card Authorisation Form.
  • You have selected an offline payment option (BPay, PayPal, AusPOST Billpay, in person, Electronic Funds Transfer) but BEFORE FlightsFlights has received the full payment in the FlightsFlights account.

"Issuing" occurs once FlightsFlights has received full payment, the Credit Card Authorisation Form (if paying by Credit Card), and has sent your electronic tickets to you.

Changes to bookings

Many of our discounted airfares are non changeable. However, if you wish to change your booked travel arrangements in any way, FlightsFlights will be happy to assist. Please contact FlightsFlights at bookings@flightsflights.com.au. In the case of changes to bookings, the following service fees will be charged.

  • Domestic airfare: Minimum $33 per person
  • International airfare: Minimum $55 per person

Cancellations of bookings

Many of our discounted airfares are non refundable. However, if you wish to cancel your booked travel arrangements, FlightsFlights will be happy to assist. Please contact FlightsFlights at bookings@flightsflights.com.au. In addition, if you fail to complete and return your Credit Card Authorisation Form, or secure an alternative payment method, FlightsFlights will cancel your booking and will levy the following booking cancellation fee against your credit card. In all cases of cancellations to bookings, the following cancellations fees will be charged.

  • Domestic airfare: Minimum $33 per person
  • International airfare: Minimum $55 per person

Changes to issued tickets

Where documents and tickets have been issued, changes can only be made if airline and supplier conditions permit. Most discounted international airfares do not allow changes to the original outbound date of departure, and most discounted domestic airfares do not allow changes to be made on the day of departure of any pre-booked flights. Please check fare rules at the time of booking as they vary by airline and type of ticket purchased. Should airline and supplier conditions allow changes to issued tickets, the following service fee will be charged in addition to any supplier fees (ie, airline fees):

  • Domestic airfare: Minimum $33 per person
  • International airfare: Minimum $55 per person

Cancellation of issued tickets

Many of our discounted airfares are non refundable. You may cancel your travel arrangements at any time, but will have to pay the following cancellation fees in addition to any cancellation fees charged by the supplier (ie, airline fees).

  • Domestic airfare: Minimum $77 per person
  • International airfare: Minimum $220 per person

  • NOTE: In addition to the above FlightsFlights service and cancellation fees against issued tickets, if you paid for your travel arrangements by credit card, the following credit card merchant fees will be levied against the amount refunded by the supplier (ie, airline and FlightsFlights fees).
  • MasterCard and Visa: 1.7%
  • American Express: 3.5%

Insurance premiums are non-refundable.

7. CHANGES AND CANCELLATIONS BY SUPPLIERS/FlightsFlights

FlightsFlights reserves the right to make changes or correct errors at any time both before and after confirmation. Flight timings, aircraft types and routings are often subject to change for operational reasons.

FlightsFlights and our suppliers reserve the right in any circumstances to cancel your travel arrangements. FlightsFlights will make every attempt to ensure that a comparable alternative is offered as soon as it is reasonably possible.

As the ticketing agent, FlightsFlights has no control over the airlines or flights, nor are we always informed of schedule changes. Therefore, you should reconfirm your flight with the relevant airlines between 24 and 72 hours prior to commencement of your journey. We accept no responsibility for bookings cancelled due to non-compliance with rules set by airlines.

8. COMPLAINTS

If you have a problem during your trip, it is a legal requirement that you bring it to the attention of the relevant supplier (e.g. your airline) as soon as possible.

If you are unable to resolve the problem locally you must obtain written confirmation from the supplier of your complaint and follow this up by writing to us within 14 days of your return.

Please include your booking reference and all other relevant details. If you fail to follow this procedure FlightsFlights cannot accept liability for any claim.

Our reservation staff is empowered to deal with complaints on the spot. Where a complaint is not dealt with to the customer's satisfaction, FlightsFlights management can be involved at any time and arrange a suitable solution.

9. OUR LIABILITY

FlightsFlights will always try to ensure that any special requests that you make are fulfilled. However, it is not always possible to guarantee such requests.

If any part of your travel arrangement is not provided, a suitable solution will be discussed and acted upon. FlightsFlights accepts responsibility for the acts and/or omissions of our employees, but will not accept responsibility for:

  • Your own acts or omissions
  • Acts of a third party not connected with the provision of your holiday and which were unforeseeable or unavoidable
  • Events which could not have been foreseen or avoided despite all due care

Our liability in all cases shall be limited to a maximum of twice the cost of your travel arrangements, excluding insurance premiums and amendment fees. However, our liability in respect of carriage by air is limited in the manner provided by the relevant international conventions and conditions of carriage. It is a condition of the acceptance of liability above that you notify us of any claim in accordance with the conditions relating to complaints.

Where any payment is made to you or any members of your party, that person must assign to FlightsFlights or its insurers any rights they may have to pursue any third party. They must agree to fully cooperate should FlightsFlights or its insurers wish to enforce those rights.

10. CONDITIONS OF CARRIAGE

When you travel with a carrier, the conditions of carriage of that carrier will apply. The conditions of carriage of that carrier are incorporated into this contract.

As your tour operator, this web site is our responsibility and is not issued on behalf of, and does not commit the airlines mentioned herein or any airline whose services are used in the course of your travel arrangements.

In accordance with Air Navigation Orders, an infant must be under 2 years of age on the date of the return flight to qualify for infant status. Please check for current rules with your airline prior to travel.

11. SCHEDULED AIRLINE BOOKING CONDITIONS

It is occasionally possible that after confirming a reservation online, an airline may reject the booking. If this occurs, FlightsFlights will contact you within 24 hours or the next working day to advise you of the situation.

FlightsFlights will not be liable for any additional costs incurred in having to purchase new tickets at a higher fare.

NOTE: Prices are not guaranteed until all payment has been received and the tickets have been issued.

BOOKINGS FOR TRAVEL ORIGINATING OUTSIDE AUSTRALIA

Bookings for Travel originating outside Australia will incur a $33 booking fee. Additional courier fees may apply.
